FAQ: What is Buyer Agency?

Buyer agency is the practice of "hiring" a real estate agent to help you buy a home.

ken lampton dallas real estate agentThe agent who "lists" a particular home is already working as a seller agent. He has a contractual relationship with the seller which obliges him to look out for the best interests of the seller. Just because he talks to you, he is not under any automatic obligation to "take care of you" or to safeguard your confidences and secrets.

Once an agency relationship is established between you (as buyer) and Ken (as your buyer agent), Ken is legally obligated to perform the following duties:

  • Loyalty - Ken is legally obligated to act at all times solely in the best interest of his client, to the exclusion of other interests.
  • Obedience - Ken is legally obligated to obey promptly and efficiently all lawful instructions from his client.
  • Disclosure - Ken is legally obligated to disclose to his client all relevant and material information that Ken knows, pertaining to the scope of the agency.
  • Confidentiality - Ken is legally obligated to safeguard the client's confidences and secrets, especially any information that might weaken the client's bargaining position.

There is no extra fee to you for Ken's services as buyer agent. In almost all cases, Ken's fee is paid from the Seller's proceeds of sale.

Ken constantly shows and previews the homes for sale in his market area. You can take advantage of Ken's knowledge of the market by doing your home shopping with him.

Ken won't burden you with high-pressure sales pitches. He is willing to work at your pace. Some folks need to buy a home right now. Others like to take it more slowly.
